Product Use Limitations, Limited Warranty, Disclaimer

Pill-Pac, Inc.'s Pill Packager ("Product") is shipped with instruction on use of the Product. Please refer to these instructions for the intended use of the Product.

Pill-Pac, Inc. warrants that the Product, when used as intended, will be free from defects in workmanship and materials for 5 (five) years from the original date of purchase (the "Warranty Period"). A Product that Pill-Pac, Inc. has previously repaired or replaced is covered by the foregoing warranty for the remainder of the original Warranty Period. This limited warranty expressly excludes defects caused by use, misuse, neglect, accident, unauthorized modifications, service or repair by anyone other than the manufacturer, and/or loss during transit. Final determiniation of warranty coverage lies solely with Pill-Pac, Inc. during the Warranty Period, and subject to proof of purchase, the Product will be repaired or replaced (with the same or similar model), at Pill-Pac, Inc.'s option. To obtain a repair or replacement within the Warranty Period, Customer must send the following to Pill-Pac, Inc., postage-prepaid: (1) the Product; (2) receipt of proof of purchase; (3) return address information; and (4) a check or money order for $11.99 to cover return shipping and handling, at the following address: Pill-Pac, Inc. 3315 E. Russell Road, Suite A-4 #197, Las Vegas, NV 89120.

THE FOREGOING SETS FORTH THE SOLE AND EXCLUSIVE REMEDIES BASED ON THE USE OR PURCHASE OF THE PRODUCT.

Pill-Pac, Inc. is not responsible or liable in any way for medications, supplements, or any other items which may be used in association with the Product, including but not limited to the appropriateness, efficacy, dosage, or frequency of use of such items. The Customer maintains full responsibility for using medications or other items used in association with the Product at appropriate times and dosages, and in accordance with his or her physician's or health care practitioner's guidance. Pill-Pac, Inc. makes no recommendations regarding the appropriateness of it's Product for use in association with medical or health-related care, and makes no warranties of any kind regarding the medical care, health, or well-being of the individual Customers. The Product is a consumer convenience product only, and is not an approved medical device.

EXCEPT AS EXPRESSLY PROVIDED ABOVE, PILL-PAC, INC. MAKES NO WARRANTY, WHETHER WRITTEN, ORAL, STATUTORY, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER WITH RESPECT TO GOODS FURNISHED TO CUSTOMER. ALL OTHER WARRANTIES ARE EXPRESSLY DISCLAIMED BY PILL-PAC INC., INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR AGAINST CLAIMS OF PATENT INFRINGEMENT OR THE LIKE. UNDER NO CURCIMSTANCE, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE, SHALL PILL-PAC, INC., OR IT'S AGENTS OR EMPLOYEES, BUSINESS PARTNERS, VENDORS, DISTRIBUTORS OR SUPPLIERS (OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS) BE LIABLE FOR ANY CLAIM OTHER THAN THE LIMITED WARRANTY SPECIFIED ABOVE FOR DIRECT, INDIRECT, INDICENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH THE USE OF, MALFUNCTION, OR THE INABILITY TO USE THE PRODUCT, EVEN IF ADVISED TO THE POSSIBILITIES OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSIONS OF CERTAIN WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
